Truth in Lending Act (TILA) Disclosure
Under the federal Truth in Lending Act (TILA), codified at 15 U.S.C.§ 1601 et seq., lenders are required to provide borrowers with clear disclosures of loan terms before the loan is consummated. These disclosures include:
- Annual Percentage Rate (APR): The cost of your credit as a yearly rate, including both interest and certain fees.
- Finance Charge: The total dollar amount the credit will cost you over the life of the loan.
- Amount Financed: The dollar amount of credit provided to you.
- Total of Payments: The total amount you will have paid when you have made all scheduled payments.
- Payment Schedule: The number, amounts, and timing of payments.

Texas-Specific Lending Regulations
Lending in Texas is regulated by the Texas Finance Code and supervised by the Office of Consumer Credit Commissioner (OCCC). Important regulations include:
- Credit Access Business (CAB) Model: Texas allows payday and auto title lenders to operate as Credit Access Businesses. CABs arrange loans with third-party lenders and charge access fees in addition to the lender's interest. This can significantly increase the total cost of borrowing. All CABs must be licensed with the OCCC.
- No Usury Cap: Texas does not impose a traditional usury cap on consumer loans arranged through CABs. Interest rates and fees on payday and title loans can be substantially higher than rates on bank loans or credit cards.
- Local Ordinances: Several Texas cities, including Houston, Dallas, San Antonio, Austin, El Paso, and others, have adopted local ordinances that impose additional restrictions on payday and title lenders, including loan-amount-to-income ratios and limits on rollovers.
- Military Lending Act: Active-duty service members and their dependents are protected by the federal Military Lending Act (MLA), which caps the Military Annual Percentage Rate (MAPR) at 36% for consumer credit products.
- Collection Practices: The Texas Debt Collection Act (Tex. Fin. Code § 392) prohibits debt collectors from using threats, harassment, or deceptive practices when collecting debts.
Credit Score Disclosure
Requesting loan quotes through Texas Loan Guide involves a soft credit inquiry, which does not affect your credit score. However, if you proceed with a formal loan application through one of our lending partners, the lender may perform a hard credit inquiry, which may temporarily lower your credit score by a small amount.
